Frequently Asked Questions
Is writing a will (Wasiyyah) obligatory in Islam?
A will regarding obligatory rights (debts, unpaid Zakat, Kaffarah) is obligatory for every Muslim. Voluntary charitable bequests are highly recommended, provided they do not exceed one-third of the estate and are not made to heirs.
Why is it forbidden to bequeath more than one-third?
The Prophet ﷺ told Sa'd ibn Abi Waqqas: 'One-third, and one-third is much. To leave your heirs wealthy is better than leaving them poor, begging from people.' (Agreed upon). The remaining two-thirds are protected for the legal heirs.
